Switzerland: Draft ordinance on due diligence published

A Swiss draft ordinance was published in April 2021. The draft addresses due diligence and transparency for minerals and metals from conflict-affected areas and child labor. While still under consultation, the law is expected to come into force on January 1, 2022.

According to the draft, all companies based in Switzerland that import or process tin, tantalum, tungsten or gold from conflict or high-risk areas will be affected by the introduction of non-financial reporting and mandatory due diligence. In addition, companies that offer products and services from geographies, where there is reasonable suspicion of child labor, are also affected. The draft provides for exemptions under certain conditions for the import of small quantities of minerals and metals and for small and medium enterprises (SMEs).
