Germany: Next stages of the Packaging Act (VerpackG) come into force

Further obligations arising from the new Packaging Act (VerpackG) will come into force this year. These include new verification obligations and an extended registration requirement.

New verification obligations since January 1, 2022

As of 1 January 2022, manufacturers of so-called B2B packaging, transport packaging, and additional outer packaging are now subject to the obligation of providing evidence of compliance of take-back and recovery requirements. Affected companies have to prepare documentation annually, by 15 May, and submit the documents to the competent authorities upon request. This obligation applies to both the initial and the last distributor.

Extension of the registration obligation as of 1 July 2022

Until recently, the initial distributor of packaging requiring system participation was the only obliged party to register in the packaging register.

From 1 July 2022, manufacturers of B2B packaging, transport packaging, and service packaging are also required to register in the packaging register. This applies to the initial distributor of all types of packaging and the last distributor of service packaging.
