Decree 2023-266 of 12 April 2023 setting the objectives and modalities for the reuse and re-employment of IT equipment decommissioned by the state and local authorities was published in the French official journal on 14 April, with entry into force on the following day.
The current decree reaffirms the national intention to reduce the carbon footprint of digital technology pursuant to the decree of November 2021 and reduce waste by enhancing reuse of IT equipment. The equipment in scope of the obligation include:
- Screens, monitors and equipment comprising screens with a surface area greater than 100cm², and
- Small computers and telecommunications equipment
Public and territorial administrations are expected to attain a gradual increase of up to 50% reuse and re-employment rates by 2025 through directing functional computer equipment they no longer use toward reuse and re-employment. The modalities of fulfilling the requirement include the transfer of IT equipment through donations, or against financial compensation, or by surrendering the equipment to producer responsibility organizations (PROs), or initial suppliers of such equipment conditional the supplier has a contract with an approved PRO, or an individual system.
The decree stipulates the execution and publication of measures to implement the requirements of the current decree by various ministries like, the Ministry of Economy, Finance and Industrial and Digital Sovereignty and the Ministry of Ecological Transition and Territorial Cohesion.
