Denmark: Sales Volume Reports in the New Danish Copyright Levy-System

As previously announced, the new system for copyright levies in Denmark has come into force at the beginning of the year. It is time now for the practical implementation. Considering that many companies have opted for a quarterly reporting frequency, the first volume reports for the new scope will soon be due.

Although the respective law was published in Denmark shortly before the end of 2021, the new tariffs that were long subject to negotiations had long been widely known. The changes were primarily intended to expand on the scope of products subject to levies and that had previously been limited to some storage media, to include devices that provide access to copyright-protected content. The decline in the copyright levy revenue Denmark has been witnessing in recent years is expected to be counteracted by the new levies on smartphones, tablets, mobile and stationary PCs.

Conversely, the changes introduced to the system mean that remuneration will no longer be levied for some analogue and digital blank media. This may consequently imply a favorable cost reduction for consumers. In the meantime, companies are faced with having to adjust to the new system beyond the required registration and notification formalities; clarifications are needed in the context of product specifications, exceptions and special arrangements. In addition, there are new obligations to provide information on invoices, audit rights of the Danish Agency and much more.
