Complex Copyright Levy System in Slovenia

New tariffs and tariff calculations for copyright levies will apply in Slovenia as of 1 July 2022. Where the levy on most products is expected to increase, some will remain unchanged.

Since the reintroduction of the levy system in 2019, there has been annual adjustments of tariffs in Slovenia. The regular adjustment has pros and cons for obligated companies. One advantage is that levies are not paid over a long period for products whose market prices have fallen significantly over that period. For example, a levy of 35 cents for a data CD, as has been the case in France for 10 years, is now higher than the average market price of the product. This is between 10 and 30 cents today; an adjustment may well be urgently needed here.

On the other hand, companies have to adjust their processes to changes and that every year in Slovenia. This may be very demanding in terms of time and effort involved. Every single tariff has to be revised, or looked into for each product to ascertain the change, or no change. In addition, the system does not differ from others in one respect: The tariff definitions are rather “broad”, which entails checking the scope and applicable levy for a vast number of products. Therefore, additional research is first needed to determine whether and to what extent, for example, game consoles or audio systems for vehicles are subject to levies.
