From 12 August 2025, online marketplaces are classified as “producers” under the UK WEEE Regulations. This change follows the introduction of extended producer responsibility for packaging (pEPR) in 2024.
Under the new regulations, online marketplaces are legally responsible for EPR compliance for goods sold via their platforms—even if they do not manufacture, import, or physically handle the products.
Under Packaging EPR, marketplaces may be deemed responsible when facilitating sales of packaged goods into the UK, particularly from non-UK sellers without an UK legal entity. Under defined circumstances, they may be treated as the de facto importer.
In a similar way, the amended WEEE Regulations require marketplaces to ensure that EEE sold by non-UK suppliers to UK households is properly registered and compliant.
You may be affected as an online marketplace or unsure whether the new WEEE and packaging regulations apply to you?
