Austria - Obligation to appoint an authorised representative for packaging

Companies that place packaging on the Austrian market via distance selling have to appoint an authorised representative in Austria. This is provided for in §16b of the Austrian Packaging Ordinance. The new obligation has been in force since 1 January 2023.

Another important change has also been in effect since the beginning of the year: Until recently, companies based in a non-EU country could also take over the extended producer obligations for packaging on behalf of an Austrian company and deliver to Austria pre-licensed. In the future, this will only be possible for companies based in the EU. The latter is then obliged to appoint an authorised representative in Austria.
